Doesn't cool consistently and LOUD!

[This review was collected as part of a promotion.] I've had this refrigerator for less than a month it has never worked correctly on top of the fact there's a huge gouge in the side the refrigerator does not cool under 40 degrees I spoke with customer service but was informed I would be charged for the for the call I put a thermometer in the fridge and freezer and have kept a log of daily temperatures approximately 2 out of 7 days the freezer will go below 10 degrees and the refrigerator we'll go under 40 degrees clearly there's a problem the information for the ice maker is incorrect and the unit itself is extremely loud

In research, the temperature recommended temperature range for the refrigerator compartment is no higher than 40 degrees Fahrenheit, per the U.S. Food and Drug Administration.
