Only 960MB/s on MacBook Pro M3 with 40Gb/s usb c

Just received this on January 10, 2025. Performed Black Magic disk speed test and I got about 970MB/s for read and write which is less 1/2 the advertised speed. I am very experienced with external SSD and own both the 8Tb Sandisk Extreme portable and the 8Tb Desk Drive SSD (which are both advertised as about 1050MB/s read/write) and Black Magic Disk speed test shows about 930MB/s which is close enough. This is on a MacBook Pro M3 with 40Gb/s usb c ports (about 5,000MB/s). Something is very wrong with this new creator series or I have just received a dud.
